§ 1 Scope and Contracting Party

(1) These General Terms and Conditions (hereinafter "GTC") apply to all orders placed via the online shop of LowmelSneaker.

(2) The contracting party is:

(3) Our deliveries, services, and offers are made exclusively on the basis of these GTC. The contractual language is German.

§ 2 Conclusion of Contract

(1) The product presentations in the online shop do not constitute a legally binding offer, but a non-binding online catalog.

(2) By clicking the "Buy Now" button (or a corresponding order button), you place a binding order for the goods contained in the shopping cart. The confirmation of the receipt of the order is sent immediately after sending the order by an automated email (order confirmation). The purchase contract is concluded upon receipt of this email confirmation.

§ 3 Prices and Shipping Costs

(1) The prices stated on the product pages include the statutory value-added tax (VAT) and other price components.

(2) Unless otherwise stated on the product page or in the shipping terms, standard shipping is free of charge. The costs for an optional express shipping will be clearly displayed during the ordering process.

§ 4 Terms of Payment

We offer the following payment methods in our shop:

  • PayPal: Payment processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A.

  • Klarna: In cooperation with Klarna Bank AB (publ), we offer various payment options (e.g., Pay later / Invoice or Pay now).

  • Credit and Debit Cards: We accept common credit cards (Visa, Mastercard, etc.).

§ 5 Retention of Title

The delivered goods remain the property of LowmelSneaker until the purchase price has been paid in full.

§ 6 Delivery Terms and Shipment Tracking

(1) Unless otherwise agreed, the delivery time is 7 to 10 working days after processing the order. Processing usually takes place within 24–48 hours.

(2) After the package has been handed over to the shipping provider, you will receive an email with a tracking code to track your shipment.

§ 7 Right of Withdrawal

Consumers are entitled to the statutory fourteen-day right of withdrawal. Detailed information, deadlines, and the sample withdrawal form can be found in our separate cancellation policy. The buyer bears the direct costs of returning the goods.

§ 8 Warranty and Transport Damages

(1) The statutory warranty rights apply.

(2) If goods are delivered with obvious transport damage, please complain about such defects immediately to the delivery person and contact us without delay at info@lowmelsneaker.com. Failure to make a complaint or to contact us does not have any consequences for your statutory rights, but it helps us to assert our own claims against the carrier.

§ 9 Limitation of Liability

For damages caused by simple negligence, LowmelSneaker is only liable if an obligation is breached whose fulfillment is essential for achieving the purpose of the contract (cardinal obligation). In the event of injury to life, body, or health, statutory liability applies without limitation.

§ 10 Final Provisions / Dispute Resolution

(1) The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
